1. Purpose and Status of This Disclaimer
This AI and Health Disclaimer explains what the artificial-intelligence-assisted features of Care Companion PRO (the “AI Features”) do, what they deliberately do not do, and what you must do before relying on anything they produce. It applies to every user of the Care Companion PRO web platform, any successor mobile applications, and all related features and services (the “Service”), operated by Spatara AI.
This Disclaimer forms part of, and is incorporated into, our Terms of Use. In the event of any inconsistency between this Disclaimer and any other document, marketing material, in-product text, or statement in relation to the AI Features or the health-related limitations of the Service, this Disclaimer governs. Capitalized terms not defined here have the meanings given in the Terms of Use.
Please read this document in full. It is short by design, and every paragraph in it matters.
2. You Are Interacting with Artificial Intelligence, Not a Human Being
The AI Features are automated software. They are not a person, not a clinician, not a nurse, not a pharmacist, not a care navigator, not a counselor, and not a companion. No human reviews, verifies, approves, or supervises any output before it reaches you.
Any conversational, friendly, or reassuring tone in the interface or in AI output is a property of language-model software. It is not empathy, it is not clinical judgment, and it must not be treated as either. We display a notification that AI output is artificially generated and not human wherever a reasonable person might be misled, and we will repeat that notification during any extended interaction.
Nothing produced by an AI Feature is the advice, opinion, recommendation, endorsement, or verified statement of Spatara AI.
3. What the AI Features Are Designed to Do
The AI Features exist to reduce administrative burden. Their entire intended purpose is organization and coordination. They may:
- summarize care notes that you or another Care Team Member wrote, so a family can catch up quickly;
- extract suggested tasks from text you entered, which you then review, edit, accept, or discard;
- help you prepare for an appointment, by helping you assemble the questions and information you have decided you want to raise;
- help organize information contained in a document you upload, such as identifying dates, names, and follow-up items so that you can file and find them; and
- draft a family update for your review, in your words and from your content, which you then edit and choose whether to send.
In every case, the AI Feature is working with information that you supplied, to produce a draft that you control. It is a clerical assistant, not an adviser.
4. What the AI Features Are Not, and Will Not Do
The AI Features are not designed for, are not intended for, must not be used for, and are configured to decline the following. You agree not to attempt to use them for:
- medical advice, a diagnosis, a prognosis, a differential, or a second opinion;
- a treatment recommendation, a care plan, a clinical protocol, or triage of any kind;
- medication advice, including dosage, timing, titration, substitution, cessation, interactions, contraindications, or side-effect assessment;
- interpretation of a laboratory result, an imaging study, a vital sign, a wound, a photograph, or any other clinical signal;
- assessment of whether a symptom, change, or event requires medical attention, or how urgently;
- therapy, psychotherapy, counseling, crisis counseling, or professional mental or behavioral health care;
- detection, inference, scoring, or diagnosis of emotional state, mental state, cognitive status, or capacity;
- legal advice, financial advice, insurance advice, benefits-eligibility advice, or tax advice;
- emergency instruction, emergency dispatch, or any life-safety function.
We may refuse, filter, limit, redirect, or decline any prompt, and may suspend access to the AI Features, in order to give effect to this Section. A refusal is the Service working correctly. If an AI Feature ever produces output of a kind listed above, whether because of a defect, a bypass, or an unanticipated prompt, that output is unauthorized, is not sanctioned by us, and must not be relied upon. Please report it to support@carecompanionpro.com.
5. Not a Medical Device; No Clinical Decision Support
The Service is intended solely for general organization, coordination, communication, and record-keeping by families. It is not intended for use in the diagnosis, cure, mitigation, treatment, or prevention of any disease or condition, and it is not intended to affect the structure or any function of the body. It is not intended to acquire, process, or analyze a medical image or a signal from a diagnostic device, and it is not intended to provide a patient-specific clinical recommendation or to drive, direct, or support any clinical decision by any health care professional.
We do not market, describe, promote, or represent the Service as a medical device, as clinical decision support, as remote patient monitoring, as a medication management or adherence system, or as a general wellness product making any claim about a disease or condition. You must not use, deploy, configure, or hold out the Service in any manner inconsistent with this Section, and you must not represent to any person that the Service performs any such function.
6. No Therapy, Counseling, or Mental or Behavioral Health Care
This point is stated separately because it is frequently misunderstood, and because several states now regulate it directly.
The Service does not provide, and does not claim or purport to provide, therapy, psychotherapy, counseling, or any service that would constitute the practice of professional mental or behavioral health care if it were provided by a natural person. No feature of the Service is a therapist, a counselor, a virtual clinician, or a substitute for any of them. The AI Features do not make therapeutic decisions, do not engage in therapeutic communication, do not generate therapeutic recommendations or treatment plans, and do not detect, infer, or evaluate emotions or mental state.
The educational material and the peer-support Community available through the Service are exactly that: self-help material, general education, and conversation between caregivers. They are not therapy and are not offered as therapy.
We do not advertise, market, or describe the Service using the words “therapy”, “AI therapist”, “counselor”, “virtual psychotherapist”, or any equivalent, and any such description would be inaccurate.
7. Accuracy Limitations: AI Output Can Be Wrong
Artificial intelligence language models are probabilistic systems that predict likely text. They do not know anything, they do not check anything, and they have no understanding of your family’s situation.
AI output can be, and sometimes will be: inaccurate; incomplete; internally inconsistent; out of date; subtly altered from your source material; or entirely fabricated. A summary may omit the single most important line in a note. An extracted task may invent a date that was never written. A drafted update may state something no one ever said. Fabricated output is frequently fluent, confident, and plausible, which is precisely what makes it dangerous.
Every output of an AI Feature is a draft. You must independently read it, check it against the underlying source, and correct it before you rely on it, act on it, share it with your family, or take it to a health care professional. You are solely responsible for any decision you make, or fail to make, in connection with AI output.
Never delete, discard, or fail to record the original source of information in reliance on an AI summary of it. Keep the original.
8. Documents and Document Summaries
Where an AI Feature helps you organize the information in a document you upload, such as discharge papers, an insurance letter, or care instructions, it is identifying and rearranging text. It is not interpreting the document for you, not telling you what the document means for your Loved One’s health, coverage, or rights, and not advising you what to do about it.
A discharge instruction, a prescription, an insurance determination, and a legal notice each carry consequences. Read the original. If you do not understand it, ask the professional who issued it, or a qualified professional of your choosing. Do not substitute an AI-assisted organization of a document for the document itself, and do not rely on such output when responding to any deadline.
9. Medication Refill Reminders Are Not Medication Management
A medication refill reminder is a calendar prompt generated from information that you typed in. It is nothing more than that.
The Service does not verify prescriptions, refill eligibility, quantities, dosage, schedules, interactions, contraindications, or clinical appropriateness. It does not connect to any pharmacy, prescriber, pharmacy benefit manager, insurer, or health record. It does not know whether a medication was actually taken, whether it should be taken, or whether it should have been stopped. It does not monitor adherence.
Do not use the Service as the sole or primary means of ensuring that any medication is taken, refilled, adjusted, or discontinued. Notifications depend on devices, networks, browsers, carriers, and settings outside our control, and may be delayed, suppressed, or not delivered at all. Maintain an independent system for anything time-critical or health-critical.
All questions about medication belong with a prescriber or a pharmacist, and nowhere else.
10. Wellness Check-ins Are Not a Clinical Assessment
Wellness check-ins are a private place to jot down how a day went, such as mood, sleep, or meals. They are a journal.
They are not a screening instrument, a validated scale, a diagnostic tool, an assessment, a monitoring service, or a form of care. Entries are not scored, interpreted, evaluated, or reviewed by us or by any clinician. We do not monitor your entries, and no entry constitutes notice to us of anything. Any chart, streak, or trend the Service displays is a presentation of what you yourself recorded and carries no clinical meaning.
Caregiver burnout, depression, anxiety, and grief are real, common, and treatable. If you are struggling, please speak to a qualified professional. This Service cannot help you with that, and it is not designed to try.
11. Emergency Information and the Emergency Care Card
Where the Service allows you to record emergency contacts or a summary of critical information, that feature is a place to keep information you have chosen to write down, so you can find it. It does not contact anyone. It does not transmit anything to any emergency service, dispatcher, first responder, hospital, or provider. It does not create any obligation on any person to read it, accept it, act on it, or rely on it.
We do not monitor Care Profiles, notes, check-ins, or Community posts for emergencies, deterioration, distress, neglect, or abuse, and we have no duty to do so. Access to the Service in an emergency may be prevented by device failure, loss of connectivity, power failure, outage, or Account suspension. Keep a paper copy or another independent means of access to anything that would matter in an emergency, and keep it current.
In an emergency, do not open this Service. Call 911 or your local emergency number.
12. Crisis and Self-Harm Response Protocol
We maintain a protocol designed to prevent the AI Features from producing content that encourages, instructs on, or normalizes suicidal ideation, suicide, or self-harm, and to respond appropriately if a user expresses such ideation. This Section is the published description of that protocol. The protocol operates as follows:
- Prevention. The AI Features are configured, through system instructions and through the safety controls of our model providers, not to produce content that encourages or provides instruction on suicide, self-harm, or harm to others.
- Referral. If a user’s input to an AI Feature indicates suicidal ideation, suicide, or self-harm, the AI Feature will not continue with the requested task and will instead display a referral notification directing the user to crisis service providers, including the 988 Suicide and Crisis Lifeline (call or text 988) and the Crisis Text Line (text HOME to 741741) in the United States, and to 911 where there is immediate danger.
- No substitution. The referral notification is a signpost. It is not an intervention, a rescue, a wellness check, or a dispatch, and the Service does not notify us, any Care Team Member, any authority, or any other person.
- Human limits. We do not staff a crisis line. No person at Spatara AI reads AI conversations in real time. Nothing you type into the Service will bring help to your door.
- Records and review. We keep a record of the number of times a referral notification was issued, and we review and update this protocol periodically and following any reported failure. We do not use those records to identify, profile, or contact any individual.
- Reporting. Where a law applicable to us requires us to report aggregate information about the operation of this protocol to a public authority, we will do so, and we will do so in aggregate form that does not identify any individual.
If you believe the protocol has failed, please tell us immediately at support@carecompanionpro.com. If you or someone else is in danger right now, call 911. If you are thinking about suicide or self-harm, call or text 988 (United States). You can also text HOME to 741741. Please do not wait, and please do not use this Service instead.
13. The Community and Educational Content
The Community is a moderated space for peer support and general educational discussion between caregivers. Posts are written by other users. We do not verify the identity, qualifications, experience, or statements of any participant, and we do not endorse any post, opinion, product, provider, facility, or service mentioned there.
Nothing in the Community, in our resource library, in our checklists, or in any educational material we publish is medical, legal, financial, or emergency advice, and none of it is tailored to your Loved One. It is general information. Treat it as you would treat a helpful conversation with a stranger who has been through something similar: potentially valuable, and not a substitute for a professional.
Your use of the Community is governed by our Community Guidelines.
14. Minors
The Service is intended for adults and is not directed to anyone under eighteen years of age. We do not knowingly permit a person under eighteen to register an Account or to use the AI Features. Do not invite a person under eighteen to a Care Team, and do not permit a minor to use your Account.
The AI Features may not be suitable for some minors. If we become aware that a user is a minor, we will disclose that they are interacting with artificial intelligence, will provide periodic reminders to take a break during any continuing interaction, and may restrict or terminate access.
15. State-Specific Notices
The following notices are given for the avoidance of doubt. They do not limit anything stated above, and they apply wherever you are located.
- Illinois. The Service does not offer therapy or psychotherapy services, is not offered by a licensed professional, and does not use artificial intelligence to make therapeutic decisions, to interact therapeutically with any person, to generate therapeutic recommendations or treatment plans, or to detect emotions or mental state. The Community and our educational material are peer support and self-help resources that do not purport to offer therapy or psychotherapy.
- Nevada. The Service does not provide, and is not represented as providing, any service or experience that would constitute the practice of professional mental or behavioral health care if provided by a natural person. It is not a substitute for a licensed provider, a school counselor, a psychologist, or a social worker.
- Utah. The Service is not a mental health chatbot. If any feature of the Service were to fall within that description, we disclose here, prominently and in advance, that any conversational feature of the Service is artificial intelligence technology and not a human being; we do not sell or share individual health information; and we do not advertise any product or service within an AI interaction.
- California and New York. Where a reasonable person might be misled into believing that they are interacting with a human, we display a clear and conspicuous notification that the response is artificially generated and not human. Our crisis and self-harm protocol is published at Section 12 above. Where the user is known to us to be a minor, we disclose that they are interacting with artificial intelligence and provide a reminder to take a break at least every three hours of continuing interaction, and we disclose that the AI Features may not be suitable for some minors.
16. Your Responsibilities
By using the Service you agree that:
- you will consult a qualified professional for every medical, legal, financial, insurance, and emergency question, without exception;
- you will independently verify every AI output before relying on it or passing it to anyone;
- you will not use the Service, or its output, to make or support a clinical decision or to provide services to any person that would require a professional license;
- you will not hold the Service out to any person, including a Loved One, a family member, a caregiver, or a health care professional, as a medical, monitoring, emergency, therapeutic, or advisory service;
- you will maintain independent means for anything time-critical or health-critical; and
- you understand that a delay, a failure, an omission, or an error in the Service or in any AI output could have serious consequences if you rely on it, and you accept responsibility for not doing so.
17. Disclaimer, Liability, and Changes
The AI Features and all output are provided “as is” and “as available”, without warranty of any kind, including any warranty of accuracy, completeness, reliability, or fitness for a particular purpose. Our liability in connection with the AI Features and with this Disclaimer is limited as set out in Section 24 of our Terms of Use, and the disclaimers in Section 23 of the Terms of Use apply in full. Nothing in this Disclaimer excludes or limits any liability that cannot lawfully be excluded or limited.
We may update this Disclaimer as the Service and the law develop. Material changes will be notified by email or in-app notice, and the “Last Updated” date will be revised. Questions about this Disclaimer may be sent to support@carecompanionpro.com.
